1. Introduction
3D WATT SERVIÇOS DE TECNOLOGIA LTDA, registered with the CNPJ/MF (Brazil's company tax registry) under No. 48.872.260/0001-83 (hereinafter "3D Watt"), offers an online system in the form of a multidirectional platform to promote and facilitate interactions between the various players in the market for Distributed Energy Resources, Distributed Electricity Generation and Energy Efficiency, facilitating the exchange of information between consumers, installers, project developers and power generators, fostering an ecosystem conducive to energy savings, cost reduction and business opportunities.
This document sets out the terms and conditions that must be observed by the administration, by the visitors and users of the www.3dwatt.com.br platform, including its tools and functionalities, or any other websites, mobile applications or service channels offered by 3D Watt.
2. Acceptance of the terms and conditions
Acceptance of these Terms and Conditions of Use is essential in order to use the platform's functionalities and tools and any other services provided by 3D Watt. By accessing or using the platform or any other services offered by 3D Watt, the user declares that they have read, understood and agreed to these Terms.
3. Definitions
For the purposes of these terms and conditions of use and a better understanding of the Platform and its functionalities, the words listed below, whether used in the singular or the plural, shall have the meaning given in these definitions, which may, however, contain certain simplifications and partial descriptions, without prejudice to the need to observe technical, legal or regulatory concepts in greater rigour or scope as the case may be.
i. Platform: refers to the set of functionalities and tools made available to users, maintained and operated by 3D Watt, hosted on the www.3dwatt.com.br domain and all the pages it comprises, whether in a public or private environment, or any other sites, APIs or service channels offered by 3D Watt and/or business partners;
ii. Visitor: any person not registered on the 3D Watt platform who accesses the information in the public area of the 3D Watt website;
iii. User: any person who accesses or uses the Platform through a previously registered Consumer, Installer, Project Developer or Power Generator profile;
iv. Consumer: an individual or legal entity representing one or more Consumer Units in the procurement of energy or the use of the electricity system with a distributor;
v. Installer: a specialist professional or company responsible for the engineering, equipment supply and installation, construction and maintenance of micro or mini distributed electricity generation systems, energy storage systems or energy efficiency;
vi. Power Generator: the legal entity holding the rights to an operating micro or mini distributed electricity generation asset;
vii. Project Developer: a specialist professional or company responsible for developing renewable distributed electricity generation projects;
viii. Consumer Unit: a set of installations characterised by receiving electricity at a single delivery point, with individual metering, corresponding to a single consumer and located on the same property or on contiguous properties;
ix. Project under Development: the Platform treats as a Distributed Generation Project under development, or simply a "Project under Development", distributed electricity generation projects that are in the structuring phase and have not yet begun injecting energy into the distributor's grid;
x. MMGD Assets: refers to renewable electricity generation projects, whether under development or in operation, which may be micro-generation, of up to 75 kW, or mini-generation, of up to 5,000 kW, intended to inject energy into the distributors' grid and participate in the Sistema de Compensação de Energia Elétrica (SCEE - Brazil's electricity net-metering scheme) under the Shared Generation, Remote Self-consumption or Multiple Consumer Unit arrangements;
xi. Profile: the role assumed by a user on the 3D Watt Platform;
xii. Content: any and all text, graphics, images, audio, video, information or other materials made available on the 3D Watt platform, on its blog or on social media, whether created by 3D Watt itself or by third parties;
xiii. Trademark: any distinctive signs owned by and/or licensed to 3D Watt that are used to identify the platform, its content or a service provided by 3D Watt;
xiv. SCEE – Sistema de Compensação de Energia Elétrica (Brazil's electricity net-metering scheme): a system in which active energy is injected by a consumer unit with micro or mini distributed generation into the local distributor's grid, transferred by way of an interest-free loan and subsequently offset against active electricity consumption or recorded as an energy credit for the consumer units participating in the system. See Lei 14.300/2022 (Brazil's legal framework for distributed generation);
xv. Shared Generation: an arrangement characterised by the bringing together of consumers, by means of a consortium, cooperative, voluntary or building-based civil condominium or any other form of civil association established for that purpose, made up of individuals or legal entities that own a consumer unit with micro or mini distributed generation, with all the consumer units served by the same distributor;
xvi. Local Self-consumption: an arrangement of micro or mini distributed generation electrically located close to the load, participating in the Sistema de Compensação de Energia Elétrica (SCEE), in which the surplus electricity generated by a consumer unit owned by a consumer-generator, whether an individual or a legal entity, is offset or credited by the same consumer unit;
xvii. Remote Self-consumption: an arrangement characterised by consumer units owned by the same legal entity, including head office and branches, or by an individual who owns a consumer unit with micro or mini distributed generation, with all the consumer units served by the same distributor;
xviii. Simultaneity: corresponds to the portion of electricity generated and self-consumed on site and at the same time, without being recorded by the meter and therefore not accounted for in the SCEE.
xix. Electricity credit: surplus electricity not offset by a consumer unit participating in the SCEE within the billing cycle in which it was generated, which will be recorded and allocated for use in subsequent billing cycles, or sold to the concessionaire or permit-holder to whose grid the consumer-generator plant is connected.
xx. EPC Contracts: (Engineering, Procurement, and Construction), for the purposes of these Terms, refers to the model for engaging the Installer to build an MMGD generation plant, whereby the Installer is responsible for all stages of the project, from engineering and procurement of materials through to final construction and commissioning.
xxi. Connection Estimate: refers to the document prepared by the electricity distributor detailing the costs and conditions required to connect a micro or mini distributed generation project to its distribution grid.
4. Rules of use
The User undertakes to use the platform in accordance with and in observance of these Terms and Conditions of Use, as well as the applicable legislation and regulation and public order. Accordingly, the User agrees that they may not:
i. Harm the rights of third parties, of whatever nature, at any time, including in the course of using the platform;
ii. Perform acts that limit or prevent other Users from accessing and using the platform under appropriate conditions;
iii. Unlawfully access the platform or third-party systems related to the platform by any means or in any manner;
iv. Spread malware or malicious software capable of causing damage of any kind, including to the equipment and systems of 3D Watt or of third parties;
v. Use mechanisms other than those expressly enabled or made available on the platform to obtain information, content and services;
vi. Carry out any acts that may in any way cause loss or damage to 3D Watt or to other Users;
vii. Access the platform's programming areas, databases or any other set of restricted information on the platform;
viii. Carry out or permit reverse engineering of, modify, alter the language of, use or otherwise dispose of the platform or its tools and functionalities in an unauthorised manner, including in a way that infringes the Intellectual Property rights of 3D Watt and/or of third parties;
ix. Use the 3D Watt domain to create links or shortcuts to be placed in unsolicited emails (spam messages) or on third-party websites or the User's own websites, or to carry out any kind of action that may harm 3D Watt or third parties;
x. Use automated data collection and selection applications to carry out mass operations for any purpose, or to collect and transfer any data that may be extracted from the platform for impermissible or unlawful purposes;
xi. Use the platform's tools and functionalities to spread messages unrelated to the platform, including messages of a racist, ethnic, political, religious or cultural nature, or that are disparaging, defamatory and/or slanderous of any person, company or social group.
The User agrees to indemnify, defend and hold 3D Watt harmless from any claim, notice, summons or judicial or extrajudicial action arising from any violation and/or infringement committed by the User, or by a third party acting on their behalf and at their behest, in relation to the Platform (including any breach of the provisions of these Terms and Conditions of Use), and is further aware that safeguarding their access password is their own responsibility.
3D Watt may, at its sole discretion, block, restrict, disable or prevent any User's access to the platform, in whole or in part, without any prior notice, whenever inappropriate conduct by the User is detected, without prejudice to any administrative, extrajudicial and judicial measures it deems appropriate.
Any attempts at fraud, whether direct or indirect and whether successful or not, shall render the perpetrator, as well as their principals, abettors, encouragers and helpers, liable to the sanctions provided for in these Terms, in addition to the relevant legal action and the obligation to compensate any parties affected by any damage caused.
5. Registration, User Profile and functionalities
To gain access to the platform's tools and functionalities, the User must create an account with personal and/or business data, which will be stored and used for identification purposes in accordance with our Privacy Policy. It should be noted that the creation of each account presupposes express consent to the collection, use, storage and processing of personal and/or business data by 3D Watt and/or by third parties engaged by it to carry out any procedure or process related to the services offered, as well as agreement to and acceptance of these terms and conditions of use.
When creating their access account, the User will set their username and access password. It is the user's sole responsibility to maintain the confidentiality of the password for their access account, and the user must notify 3D Watt immediately in the event of disclosure or theft of the password or of any unauthorised use of their account.
On registering, each user will have only one access account, for which they must choose a profile of:
1. Consumer;
2. Installer;
3. Project Developer; or
4. Power Generator.
Each set of login information will be associated with the chosen user profile.
On completing their access account, the user declares that the information provided is complete, true and current, and it is the user's full responsibility to update their profile data whenever there is a change of name, address or any other relevant information.
Users are entirely responsible for the information they register. 3D Watt exercises no influence over and assumes no responsibility for such information, except where expressly stated in a specific arrangement.
3D Watt is not responsible for the quality, accuracy or truthfulness of the information entered by the user and made available on the platform, regardless of whether or not it has supported such information through simulation or matching tools. You agree that use of the platform and of any Content is entirely your own responsibility, and that under no circumstances will 3D Watt be liable for any Content or for any loss or damage of any nature incurred as a result of the use of any information or content made available through the platform.
The 3D Watt Platform may act preventively in verifying and checking the information entered by its users on the platform, and may, at its sole discretion, refuse, suspend or cancel a user's content or access account whenever it establishes or suspects that the information provided is false or breaches laws, principles of good faith or the clauses of its terms and conditions of use.
5.1. Consumer User Profile
The Consumer User may register free of charge on the 3D Watt platform and enjoy the following functionalities:
i. Use the 3D Watt Solar Simulator to run a simple simulation, using generic data, to estimate the specification, operation and economic benefits of a solar generator: the simple simulation will estimate the preliminary characteristics of a solar PV generator based on location information and a representative energy bill amount.
ii. Register Consumer Units and display, edit and share their information: the Consumer may register consumer units that they own or manage, together with their relevant basic information. The Consumer user may register as many consumer units as they wish, free of charge.
iii. Use the information from a previously registered Consumer Unit to run a more accurate simulation of the sizing, generation and offset of a solar PV generator.
iv. Search for and select Installers to request a quote for a Generation System based on a registered Consumer Unit: the platform will select and display the list of Installer companies able to submit a quote, based on the geographic criteria of the Consumer Unit and the experience reported by the Installer. The Consumer user may view the details and contact information of a specific Installer; however, contact, the sharing of additional information or the continuation of any negotiation shall take place at the Consumer user's initiative and sole discretion and outside the platform environment.
v. Search for and select Installers to request a quote for a Generation System using the Platform's filters: the platform provides filters for searching for Installer companies, based on geographic criteria and the experience reported by the Installer. The Consumer user may view the details and contact information of a specific Installer; however, contact, the sharing of information or the continuation of any negotiation shall take place at the Consumer user's initiative and sole discretion.
vi. Search for and select distributed electricity generation projects (Operating Plants) in order to request and receive proposals for participation quotas in shared-generation cooperatives, associations or consortia and to benefit from energy credits. Searches for Operating Plants may be carried out from a previously registered Consumer Unit, through matching by electricity distributor or by freely applying search filters.
5.2. Installer User Profile
The Installer User may register free of charge on the 3D Watt platform and enjoy the functionalities available under the free Start plan, or add further functionalities by subscribing to the Basic Plan.
5.2.1. Under the free "Start" plan, the user with an Installer profile may:
1. Register and promote their company, specifying its portfolio of services and the states or cities where it operates, information that will be used as search filters by other users;
2. Receive contacts and requests from other users for quotes for distributed generation systems or related services;
3. Use the 3D Watt Solar Simulator to run a simple simulation with generic data: the simple simulation will estimate the preliminary characteristics of a solar PV generator based on location information and a representative energy bill amount. The simple simulation may be carried out in the public environment without the need to log in.
5.2.2. By subscribing to the Basic Plan, in addition to the functionalities of the "Start" plan, the Installer user may:
1. Search, using geographic or generation-source filters, and display additional information on operating micro or mini distributed generation plants that are registered on the Platform and interested in maintenance proposals.
2. Use the 3D Watt Solar Simulator to run a simulation with their own main input parameters and generate detailed, more accurate reports on the estimated generation, offset and energy bills in the first year of generation;
5.3. Project Developer User Profile
The Project Developer User may register free of charge on the 3D Watt platform to publicise specific interests relating to their distributed generation projects, whether under development or already in operation, such as prospecting for business opportunities, partnerships, or the leasing or sale of the asset. The user with a Project Developer profile on the 3D Watt Platform may:
1. Register and publicise assets free of charge - Projects under Development and Operating Plants - and display, edit and share their information. The Project Developer may register assets that they own or manage as an agent, including information on the project's status, the status of the Connection Estimate (Parecer de Acesso - the distributor's grid connection opinion) and the project's interests on the 3D Watt platform. Operating plants whose interest on the Platform is to offer participation quotas in shared-generation projects (energy subscription) must form part of specific commercial arrangements between the Power Generator and the 3D Watt Platform.
2. Search for and select, using the Platform's filters, Installers with experience in EPC of mini-plants in order to request quotes. The platform provides filters for searching for Installer companies, based on geographic criteria and reported experience. The Project Developer user may view the details and contact information of a specific Installer; however, contact, the sharing of information or the continuation of any negotiation shall take place at the Project Developer user's initiative and sole discretion, outside the platform environment.
Projects under development that are interested in technical, regulatory or legal advisory services may get in touch with the 3D Watt platform so that, through a specific arrangement and outside the platform environment, they may learn about the portfolio of services offered by 3D Watt in supporting project structuring and providing sell-side support in asset transactions.
In cases where there is interest in selling the asset, business leads for the acquisition of an asset listed on the 3D Watt Platform and originated through 3D Watt users or partners will be reported to the Project Developer user profile responsible for registering that asset, and, where there is interest, the continuation of negotiations may take place under a specific intermediation contract between the asset's owner or their agent and 3D Watt, with remuneration agreed in advance and conditional on the success of the transaction.
5.4. Power Generator User Profile
The Power Generator User may register free of charge on the 3D Watt platform to publicise specific interests relating to their operating distributed generation assets. The user with a Power Generator profile on the 3D Watt Platform may:
1. Register assets free of charge - Operating Plants - and display, edit and share their information. The Power Generator may register assets that they own or are responsible for as manager or agent, including information such as the plant's capacity, the electricity distributor to which it is connected and the project's interests on the 3D Watt platform.
2. Have their assets displayed in the platform's search filters and matches, with the proviso that the receipt of leads from Consumer users for remote self-consumption or participation in the legal vehicles for Shared Generation is reserved for Power Generators with specific commercial partnership contracts with the 3D Watt Platform.
3. Search for and select MMGD assets under development using filters and matches based on affinity of interests. The platform provides filters and matches for searching for assets under development, based on geographic criteria, generation sources or electricity distributor. The Power Generator user may view the main information and technical details of a specific asset; however, contact, the sharing of additional information or the continuation of any negotiation shall take place at the initiative and sole discretion of the Project Developer user, owner or agent of that asset.
Power Generators interested in 3D Watt's services supporting the sale or acquisition of assets may get in touch with 3D Watt so that, through a specific arrangement and outside the platform environment, they may learn about the portfolio of services offered by 3D Watt in providing "sell-side" or "buy-side" support in MMGD asset transactions.
Business leads for the acquisition of an asset listed on the 3D Watt Platform and originated through 3D Watt users or partners will be communicated to the profile of the user who is the owner or agent of that asset, and, where there is interest, the continuation of negotiations shall take place under a specific intermediation contract between the asset's owner and 3D Watt, with remuneration conditional on the success of the transaction.
6. Subscription Plans and Payment Gateway
6.1. Plans and Subscription
The Platform has a Basic Plan of functionalities available according to the user profile, with exclusive functionalities currently available only to Installer users. To access them, the Installer user may choose to take out a monthly subscription to the Basic Plan.
6.2. Payments
Subscription payments will be charged automatically to the credit card provided at the time of subscription, through the PagSeguro payment gateway. The Plan subscription will renew automatically at the end of each billing period, unless the User cancels the subscription before the renewal date. Charging will take place at the start of each monthly billing cycle, and the issuing of tax invoices (notas fiscais) for the subscription services, where applicable, will occur within 5 business days of the payment made.
6.3. Cancellation
1. 3D Watt may terminate these Terms, user accounts or users' access to the platform and its functionalities at any time, without prior notice or consent and at its sole discretion. In the event of termination, both 3D Watt and the users will remain liable for any debts they may owe one another, and termination shall not release either party from obligations already undertaken.
2. The User may cancel their subscription at any time using the buttons in the account settings area on the Platform. After cancellation, access to the exclusive functionalities of a given subscription plan will be maintained until the end of the current billing period, after which the subscription will not be renewed.
6.4. Chargebacks and Refunds
The process for chargebacks and refunds of payments on the Platform is carried out in accordance with the Código de Defesa do Consumidor (Lei nº 8.078/1990) (Brazil's Consumer Protection Code), under which the User may request cancellation of the subscription and a full refund of the amount paid within 7 (seven) calendar days of taking out the subscription, if they are not satisfied with the services. In this case, the User must clearly express their intention to cancel by email to atendimento@3dwatt.com.br. The Platform will proceed with the cancellation arrangements with PagSeguro within 48 hours of the moment the cancellation request is received, and the refund will occur within 30 days of the User sending the request.
6.5. Price Changes
The 3D Watt Platform reserves the right to change the price of its subscription plans at any time. Any price change will be communicated to the User at least 30 (thirty) days in advance. Continued use of the subscription after the price change will be deemed acceptance of the new prices.
6.6. Payment Failures
In the event of a failure to pay the subscription, the User will be notified and will have a period of 10 (ten) calendar days to remedy the situation. If payment is not made within this period, the subscription will be automatically cancelled and access to the exclusive functionalities will be discontinued.
7. Personal data, privacy and security
3D Watt has a specific Privacy Policy governing the collection, safekeeping and use of personal data, as well as its security. The 3D Watt Privacy Policy is an inseparable part of these Terms and Conditions of Use, it being noted that platform usage data will be archived in accordance with the legislation in force.
8. Industrial and Intellectual Property Rights8.1. Trademarks All content on the Platform, including but not limited to text, graphics, logos, icons, images, audio clips, data compilations and software, is the exclusive property of 3D Watt or of its business and content partners and is protected by Brazil's Intellectual Property laws.
8.2. 3D Watt Content All content on the platform - including the domain name www.3dwatt.com.br, programs, databases, files, text, photos, layouts, headers and other elements - was created, developed or assigned to 3D Watt, is owned by or licensed to 3D Watt and is protected by Brazilian laws and international treaties governing intellectual property rights.
8.3. User Content By submitting content to the Platform, including but not limited to text, data and other materials, the User grants 3D Watt a worldwide, non-exclusive, royalty-free and transferable licence to use, reproduce, distribute, prepare derivative works from, display and perform that content in connection with the operation of the Platform and its business, always in accordance with its Privacy Policy.
9. Responsibilities, limitations and disclaimers of the parties
3D Watt uses its best efforts to inform, assist and protect the User. The User is solely responsible for the use of the platform and its tools and functionalities. Under no circumstances shall 3D Watt or its directors, representatives, agents, employees, partners, business partners or service providers be held liable for any consequential, indirect or punitive damage, loss of profits or other monetary losses relating to any claim, legal action or other proceeding brought in connection with the use of the platform, its content, functionalities and/or tools. In particular, 3D Watt's liability is excluded for any loss or damage the User may suffer as a result of platform failures, including those arising from system failures, always subject to the following terms:
9.1. 3D Watt Disclaimer
1. 3D Watt does not own and holds no stake in energy assets of any kind, whether under development or in operation. It does not manufacture, represent, distribute or sell photovoltaic modules, mounting structures, inverters, biodigesters, cables or any other equipment or materials used in the delivery of MMGD generation projects.
2. 3D Watt does not own and holds no stake in installer companies, energy traders in the free market (ACL - Ambiente de Contratação Livre, Brazil's free contracting market) or generators, such that any and all relationship between the platform and these companies is stated or provided for in these terms and conditions, in particular the partnership with the Power Generator User regarding access to leads from Consumer users for remote self-consumption or participation in the legal vehicles for Shared Generation.
9.2. Use of the 3D Watt Simulators
3D Watt Solar Simulator: the 3D Watt Solar Simulator is intended to present estimated results based on customary reference considerations and assumptions, supported by proprietary databases, equations and algorithms drawn from climatological databases and photovoltaic technology, as well as economic and financial parameters and Lei 14.300/2022. Such assumptions and considerations may vary or differ for a specific real project, so that the results provided by the 3D Watt Simulator should not be regarded as an accurate benchmark of the real performance of a solar generator or of the associated economic or environmental aspects, and the need to consult qualified professionals and installer companies therefore remains. By using the simulator, the user agrees that the results are indicative and that there is no guarantee of precision or accuracy.
9.3. Compliance with laws and regulations
The 3D Watt Platform and its functionalities seek full compliance with all laws and regulations applicable to its activities and expect the same compliance from its users. However, 3D Watt cannot guarantee the full legal and regulatory compliance of its users in their activities. By using the 3D Watt platform, the user declares that they are aware of, understand and agree that they are solely and fully responsible for compliance with any and all laws, rules, regulations and legal and tax obligations applicable to the services they offer on the Platform, and are likewise solely and fully responsible for verifying compliance with any and all laws, rules, regulations and legal and tax obligations applicable to the activities and services of other Platform users with whom they enter into contracts, dealings or agreements on a bilateral basis outside the platform environment or without its intermediation. A User who becomes aware of any inappropriate action or condition by another user in relation to laws, rules, regulatory acts or these Terms must immediately report that user to 3D Watt, through the communication channels provided for in these Terms, so that appropriate measures may be taken.
9.4. Verification of users' information and content
3D Watt does not guarantee the accuracy or authenticity of the information and content provided by users and has no obligation to verify or monitor them. However, 3D Watt reserves the right to do so, either directly or through its algorithms or qualified third parties, in order to ensure the quality of the information and of the interactions between users and compliance with these Terms, or to comply with the applicable legislation and regulation or with an order from a competent authority. These checks include, but are not limited to:
1. Verifying the accuracy, authenticity and currency of profile information;
2. Checking professional and criminal background, online reputation or any other information that may help 3D Watt assess the User's ability to use the functionalities and to contribute or interact in a proper and positive manner with 3D Watt or other Users;
3. Accessing, viewing and monitoring information and content posted or transmitted by the User through the Platform.
4. Requiring documents that prove the truthfulness of a piece of information or the rights or representative capacity as owner or agent of an asset.
9.5. Limitation of liability for the conduct of Users and third parties
3D Watt does not endorse any User and bears no responsibility for the conduct of Users or of third parties contacted or engaged through the platform. Although it may take on responsibilities as representative, agent or attorney-in-fact of a specific User, 3D Watt explicitly disclaims responsibility for any act or omission of any User in relation to other Users or third parties. By using the platform, the User agrees that any legal or civil liability action arising from the act or omission of users or third parties will be limited to a claim against them, releasing 3D Watt, or its shareholders, managers or employees, from any liability. 3D Watt further recommends that, before entering into any engagement, partnership, purchase, sale or any other interaction capable of giving rise to binding contracts or agreements, you verify the full compliance of the potential contractor, client, partner or any other party to the binding relationship as regards their conduct in the market, including but not limited to: experience and track record; client references; technical and management team; documentation, clearance certificates and licences.
9.6. Partial applicability
Should 3D Watt fail to enforce or perform any clause or condition contained in these Terms and Conditions of Use or in its Policies, this shall not constitute a waiver, forbearance or novation of that clause or condition of these Terms or of any Policy. If any clause or condition contained in these Terms and Conditions of Use or in the Policies is declared unenforceable, in whole or in part, such unenforceability shall not affect the remaining clauses of the Terms and Conditions of Use and of the Policies. In such a case, 3D Watt will make the necessary adaptations so that they reflect, as closely as possible, the terms of the provision declared unenforceable.
10. Updates to these Terms and Conditions
These Terms and Conditions of Use and the Policies are of indefinite duration and will remain in force for as long as the platform is active. The applicable wording is that of the update immediately preceding access. Likewise, access to and use of the platform and its functionalities are, in principle, of indefinite duration, at 3D Watt's sole discretion. 3D Watt may unilaterally review, enhance, modify and/or update, at any time, any clause or provision contained in these Terms of Use or in the Policies associated with them. The updated version will apply to use of the platform and its functionalities carried out from the moment it is published by 3D Watt. Continued access or use after the publication of any modifications will confirm the User's acceptance of the new Terms and Conditions of Use or the new Policies. Should a User disagree with a particular change to the Policies or to the Terms and Conditions of Use, they may terminate their relationship with the Platform through the communication channels made available in these Terms. Such termination will not, however, release the User from complying with all obligations undertaken under the previous versions of the Policies and of the Terms and Conditions of Use.
11. Applicable law and jurisdiction
The platform is controlled, operated and administered by 3D Watt Serviços de Tecnologia Ltda in the city of Porto Alegre, State of Rio Grande do Sul, Brazil, and may be accessed from any device connected to the Internet, regardless of its geographic location. By accessing the platform, the User agrees that the applicable legislation for the purposes of these Terms and Conditions of Use will be that in force in the Federative Republic of Brazil. 3D Watt and the User agree that the courts of the city of Porto Alegre, RS, Brazil, will have sole jurisdiction to settle any question or dispute arising from or resulting from the use of the platform, expressly waiving any other, however privileged.

In addition, the 3D Watt Platform provides on its website a FAQ (frequently asked questions) section, as well as its policies and other terms that complement and form part of these Terms and Conditions of Use. Exceptionally, in informal communications, 3D Watt may communicate with users and followers through its social media or other convenient means of communication.
